The Meaning of Fiduciary Duty - "Old-Fashioned Lawyering"

I have practiced law for 35 years, and have protected the rights of individuals and businesses throughout North TexasWalter Cowger for more than 20 years. I became a lawyer because I wanted to help people and businesses through difficult times. I believe strongly in my fiduciary obligations to clients, and will always consider only your interests and not my own. I will always strive to represent you with diligence, experience, and integrity.

I think of this approach to law as "old-fashioned lawyering." While the concept of fiduciary duty has weakened as law practice has become more of a business, I believe that a firm commitment to it is the only way to ensure that clients get the representation they expect and deserve.

I was a partner in the firm of Akin, Gump, Strauss, Hauer & Feld, LLP, for fifteen years, from 1987 to 2002, before opening the Law Office of Walter S. Cowger in 2002.

My Practice

I offer comprehensive and experienced representation in matters involving:

  • Employment litigation defense: I defend businesses in employment-related disputes, including allegations of discrimination or harassment, breach of contract or wrongful discharge, unemployment claims, FLSA, FLMA, and ERISA actions.
  • Fiduciary Litigation:  I represent both plaintiffs and defendants in lawsuits involving claims of breach of fiduciary duty.  Such claims arise in a varitey of factual settings.  I have both prosecuted and defended legal malpractice claims; represented the trustee of a family trust who was wrongly accused of mishandling trust assets; and defended breach-of-fiduciary duty claims arising in disputes between shareholders of closely-held corporations and members of limited liability companies.
  • Business Disputes: I represent businesses and business owners who are plaintiffs or defendants in commercial controversies, including breach of contract, deceptive trade practices and business torts.
  • Employment contract negotiation: I counsel employers and employees at all stages of the negotiation of employment-related agreements, including severance packages.

Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization Since 1996

I also conduct internal investigations for companies that face allegations of discrimination or sexual harassment. I can thoroughly review all charges and provide you with a complete analysis of the merits and shortcomings of these claims, so that your regular corporate counsel doesn't risk being disqualified from representing you if a lawsuit is filed.
