Representation of Trustees in Trust Disputes

I handle all types of lawsuits involving allegations of wrongful conduct by trustees, including assertions of:

  • Breach of fiduciary duty: A trustee has a duty to act in the best interests of the trust beneficiaries. The particulars of this obligation, however, are very fact dependent. I protect the rights of trustees who have been accused of promoting other interests over the interests of the beneficiaries.
  • Negligence in the handling of trust assets: I will defend you on charges that you mishandled trust funds, including trust investments, or that you wrongfully disbursed or failed to disburse trust funds.
  • Self-dealing or conflict of interest: I represent trustees who have been accused of putting their own interests above those of the trust or the trust beneficiaries.

I can advise you at any stage of trustee litigation, whether it has merely been threatened, or a lawsuit has been filed against you. I will conduct a thorough investigation of the allegations, and will prepare and submit all necessary documentation throughout the process. I will also be your voice in all hearings and other proceedings, including interviews or depositions of witnesses, mediation, and trial. I am always conscious of the expense of quality legal representation, and I strive at all times to provide cost-effective counsel that meets your needs.

When representing plaintiffs in breach of fiduciary duty cases, I will apply the same level of expertise and diligence toward prosecuting the plaintiff's claims against the fiduciary involved.
